Terms & Conditions

These Terms & Conditions (“Terms”) govern your access to and use of this website and the purchase of products from House of Swirls DMCC (“Company”, “we”, “us”, “our” when used generically; for legal purposes the contracting party is House of Swirls DMCC). By accessing or using the site, you agree to be bound by these Terms, our Sales Policy, and our Cake Care Instructions. If you do not agree, do not use the site.

1. Company & Scope

House of Swirls DMCC operates from Shop P8, DG1, Cluster Q, JLT, Dubai, UAE. These Terms apply to all site visitors and customers placing orders through our website.

2. Eligibility & Accounts

You must be at least 18 years old to place orders. Orders for minors must be placed by a parent or legal guardian.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

3. Pricing, Currency & Payment

Prices are listed in AED and may include VAT where applicable.
Accepted payment methods include Visa/Mastercard and bank transfer. Full advance payment is required to confirm an order.
Approved refunds are returned to the original method of payment.

4. Orders, Lead Time & Substitutions

Standard lead times: 3–4 business days for most custom cakes; approximately 7 days for wedding cakes. Acceptance of short-notice orders is at our discretion.
All cakes are handmade; reasonable variations in color, finish, size, and design may occur.
If a specific ingredient or decorative component is unavailable, we may substitute an equivalent of equal or greater value.

5. Delivery, Pickup & Risk of Loss

Delivery timing is subject to traffic and availability. We recommend scheduling delivery for the day before your event and refrigerating the cake until serving.
Risk transfers to the customer upon delivery or pickup once the cake is received in good condition. Customers should inspect the cake at handover.

6. Cake Care & Food Safety

Products are prepared in accordance with applicable Dubai Municipality food safety standards.
Customers must follow our Cake Care Instructions (including guidance on transport, refrigeration, and serving). Failure to follow these instructions may result in spoilage or damage for which we are not responsible.

7. Structural & Non-Edible Supports

To ensure stability, certain cakes may contain non-edible supports (e.g., wooden/plastic dowels, internal forms, wires, toothpicks, floral picks). These items are standard in professional cake construction and must be removed before consumption. Customers are responsible for supervising children and preventing ingestion of non-edible components.

8. Changes, Cancellations & Post-Order Adjustments

Cancellations made three (3) business days or more before the scheduled delivery/pickup date are eligible for a full refund.
Cancellations made less than three (3) business days before the scheduled delivery/pickup date incur a 50% charge.
Changes to delivery date, delivery location, or design must be requested at least three (3) business days in advance.
Additional costs may apply for approved late changes.

9. Complaints & Remedies

Any dissatisfaction, defect, or damage must be reported within 24 hours of delivery/pickup and include photographic evidence.
We may request that the cake (or a portion) be returned the same day for assessment.
Where appropriate, our remedies may include repair, replacement, or refund. The maximum refund or compensation is limited to the amount paid for the cake and any delivery fee.

10. Prohibited Resale & Brokering

For safety, quality control, and brand integrity, products may not be purchased for resale, brokering, or sale at a markup without our prior written consent. Unauthorized resale may result in legal action.

11. Intellectual Property & Site Use

All site content (text, images, designs, code) is the intellectual property of House of Swirls DMCC. No license is granted except for personal, non-commercial use of the site to browse and place orders.
You may not copy, reproduce, distribute, modify, or create derivative works without prior written consent.
Third-party links are provided for convenience; we are not responsible for their content or practices.

12. Disclaimers & Limitation of Liability

The site and products are provided “as is” to the fullest extent permitted by law. We disclaim all warranties, express or implied, regarding site availability, accuracy, or fitness for a particular purpose.
We shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or relating to the use or misuse of our products, including damages resulting from improper handling, storage, or consumption after pickup or delivery.
In all events, our total liability shall not exceed the amount paid by the customer for the specific product or service in question.

13. Indemnity

You agree to indemnify and hold House of Swirls DMCC harmless from claims, losses, or liabilities arising from your breach of these Terms or misuse of the site or products.

14. Compliance, Sanctions & Force Majeure

We do not provide products or services to sanctioned persons or jurisdictions in violation of applicable laws.
We are not liable for delays or non-performance due to events beyond our reasonable control (including but not limited to extreme weather, traffic disruptions, power failures, or supply shortages).

15. Relationship to Sales Policy & Cake Care Instructions

These Terms should be read together with our Sales Policy and our Cake Care Instructions. In the event of conflict, these Terms prevail for website and legal matters; the Sales Policy governs practical order handling, refunds, and delivery procedures.

16. Miscellaneous

Severability: If any provision is held invalid, the remaining provisions remain in effect.
No Waiver: Failure to enforce any provision is not a waiver of rights.
Assignment: You may not assign rights or obligations without our consent.
Amendments: We may update these Terms at any time; continued use constitutes acceptance of the revised Terms.
